Who this notice covers
This notice explains how Tuling Creative Hub ("Tuling", "we", "us") handles personal data on this website (hrms.tulingcreativehub.com) and in connection with Tuling HRMS. We are at Sector 61, Noida, Uttar Pradesh, India. Contact: support@tulingcreativehub.com.
Two roles matter. For data you give us on this website (enquiries, demo and trial requests), we decide why and how it is used, so we are the data fiduciary. For the employee and HR data a customer company keeps inside Tuling HRMS, the customer company is the data fiduciary and Tuling is its data processor. That data is governed by the customer's agreement with us and the Data Processing Addendum, and by the customer's own privacy notice to its employees.
What we collect
- Enquiry data: your name, work email, phone number (optional), company name, number of employees, and what you write in the message box.
- Technical data your browser sends: IP address, browser type and the pages requested, kept in server logs for security and troubleshooting.
- A small item stored in your browser to remember that you have seen our cookie notice.
We do not ask for more than the forms show. We do not knowingly collect data from children, and this website is not for them.
Why we use it, and the legal basis
- To reply to your request and arrange a demo, trial or quote. Basis: your consent, given when you submit the form, and our legitimate use to respond to a request you made.
- To keep a record of the enquiry and run our business. Basis: legitimate uses permitted by the DPDP Act, such as responding to a request you made.
- To keep the website secure and fix faults. Basis: reasonable security practices required of us.
- To meet legal obligations such as tax and accounting records.
We do not sell personal data and we do not use it for automated decisions about you. We will ask for fresh consent before using your data for a new purpose.
Who we share it with
Only with service providers who help us run the website, email and hosting, who act on our instructions and are bound to keep it confidential, and with authorities when the law requires. The current list of providers is on the Sub-processors page.
Where we share data with a provider outside India, we do so only where Indian law permits and with suitable safeguards. Our application and database are hosted in India.
How long we keep it
We keep enquiry data for as long as it is needed to handle your request and for a reasonable period afterwards for our records, normally not more than [24] months from your last contact, unless a longer period is required by law. We keep server logs for a limited period needed for security. After that we delete or anonymise the data.
Security
We use reasonable security safeguards, including access controls, firewalling of servers and logging, to protect personal data against unauthorised access, loss or misuse, in line with Section 43A of the IT Act, 2000 and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and with the DPDP Act, 2023.
If a personal data breach affects you, we will tell you and the authority as the law requires.
Your rights
Under the Digital Personal Data Protection Act, 2023 you may:
- ask for a summary of the personal data we hold about you and how it is used;
- ask us to correct or complete it, or to erase it when it is no longer needed;
- withdraw your consent at any time (this does not affect what we did before you withdrew it);
- make a grievance to us, and, if it is not resolved, complain to the Data Protection Board of India;
- nominate another person to exercise your rights if you die or become unable to.
Write to support@tulingcreativehub.com with the subject "Privacy request". We will confirm your identity and reply within the time the law sets, and in any case within one month for grievances.
